Leave & Licence Agreement Safer Option for Property Owners Than Rent Agreement in India

Chandigarh (Gurpreet Singh): Legal experts have advised property owners across India to prefer a Leave and Licence Agreement over a traditional Rent (Lease) Agreement, as it offers better legal protection and easier recovery of possession.

Under Indian tenancy laws, a Rent or Lease Agreement creates tenancy rights in favour of the occupant, often making eviction a lengthy and complex legal process under various state Rent Control Acts. These laws were designed to protect tenants but have resulted in long court battles for landlords.

In contrast, a Leave and Licence Agreement, governed by the Indian Easements Act, 1882, does not transfer any interest in the property. The occupant is treated only as a licensee with limited usage rights for a fixed period, usually 11 months.

Legal experts say this format helps owners avoid rent control complications, ensures better control over property use, and allows quicker action in case of breach of terms. However, they caution that merely naming an agreement as Leave and Licence is not enough. The terms must clearly show temporary permission and not long-term possession.

With rising property disputes in urban areas, owners in cities like Chandigarh, Delhi, Mumbai and Gurugram are increasingly opting for Leave and Licence agreements for both residential and commercial properties.

Experts recommend that property owners get such agreements properly drafted and registered as per state laws to prevent future legal disputes.
